Air Bags Don’t Deploy in Auto Accident, Lexus Driver Wins $6.5 Million

A Lexus driver recently won $6.5 million dollars in a lawsuit against Toyota Motor Corporation when her airbag failed to deploy. In an attempt to avoid an accident with another driver, the driver of the Lexus – Katherine Sprague – ended up colliding with a limestone wall. Because her side airbag didn’t deploy, she endured several dislocated vertebrae, as well as neck injuries.

Because Sprague attributed the severity of her injuries to the airbag malfunction, she decided to take Toyota to court. Sprague’s attorneys contended that Sprague’s neck and back issues were the direct result of a defective airbag. Had it deployed fully, the cushioning would have mitigated Sprague’s violent whiplash and prevented her from hitting her head against the steering wheel. Toyota countered, claiming that Sprague’s loose seatbelt exacerbated her injuries – not the airbag system.

Ultimately, a jury found that the vehicle “did not conform to generally recognized and prevailing state of the art” standards in the auto industry at the time. They decided in favor of Sprague, awarding her 6.5 million dollars for medical bills resulting from her injuries, future medical care and personal damages.
